MyPocono Terms of Use (EULA)

These Terms of Use (“Terms” or “EULA”) govern your use of the MyPocono mobile
application (“MyPocono”, the “App”), operated by Pocono Business News, publisher
of pbnews1.com (“we”, “us”, “our”). By downloading, installing, or using
MyPocono, you agree to these Terms. If you do not agree, do not use the App.
 
1. License
Subject to your compliance with these Terms, we grant you a limited,
non-exclusive, non-transferable, revocable license to install and use MyPocono
on any Apple-branded device that you own or control, and as permitted by the
Apple Media Services Terms and Conditions, or on any Android device that you
own or control, and as permitted by the Google Play Terms of Service.
You may not: copy, modify, or distribute the App; reverse engineer, decompile,
or attempt to derive source code; sublicense, rent, or lease the App to any
third party; remove or alter proprietary notices; or use the App for anything
unlawful.
 
2. Your account
To use most features of MyPocono, you must create an account with a valid
email address or sign in through Apple, Google, or Facebook. You are
responsible for keeping your account credentials secure and for all activity
that occurs under your account. You must be at least 13 years old to create
an account. If you are under 18 you represent that a parent or legal guardian
has reviewed and accepted these Terms on your behalf.
 
3. Subscriptions and in-app purchases
MyPocono offers the following paid features, purchased through the App Store
or Google Play. All prices are shown in your local currency in-app before
purchase and may vary by region.
 
3.1 Auto-renewable subscriptions
MyPocono Premium (Monthly) access to the Premium tier for one month.
MyPocono Premium (Yearly) access to the Premium tier for one year.
MyPocono Business Account (Monthly) Business Owner features for one month.
MyPocono Business Account (Yearly) Business Owner features for one year.
 
Payment.
Payment is charged to your Apple ID or Google account on
confirmation of purchase.
 
Renewal.
Subscriptions automatically renew for the same period at the
then-current price unless you turn off auto-renewal at least 24 hours before
the end of the current period. Your account will be charged for renewal
within 24 hours before the end of the current period.
 
Managing your subscription.
You can manage your subscription and turn
off auto-renewal in your Apple ID account settings
purchase. Cancellation of the current subscription is not allowed during the
active subscription period.
 
No refunds for the current period.
Refunds for the current subscription
periods are not offered except where required by law.
3.2 Consumable in-app purchases
Nomination Credit ($2.99 USD), one credit to submit a Person of the
Week nomination. Consumed on submission and non-refundable once used.
3.3 Non-consumable and one-time purchases
Featured Placement: timed promotional placement of a business listing.
Delivered for the purchased duration; not refundable after activation.
3.4 Free trials and promotional pricing
If a subscription includes a free trial and you do not cancel before the
trial ends, you will be charged for the subscription. Any unused portion of
a free trial is forfeited when you purchase a subscription. Promotional
pricing applies only to the initial subscription period.
 
4. Content you post
MyPocono lets you publish community posts, comments, reviews, nominations,
business submissions, and other user-generated content (“User Content”). You
retain ownership of your User Content. By posting, you grant Pocono Business
News has a worldwide, non-exclusive, royalty-free license to host, display,
reproduce, modify (for formatting), and distribute your User Content within
MyPocono and in related editorial promotion.
You represent that you own or have the necessary rights to the content you
post, and that your content does not infringe on anyone else’s rights or
violate these Terms.
 
5. Acceptable use
You may not:
– Post content that is unlawful, harassing, defamatory, hateful, sexually
explicit, violent, or that targets a private individual.
– Impersonate any person or business, or misrepresent your affiliation.
– Post spam, promotional content outside designated business features, or
content that includes malware or scraping tooling.
– Interfere with, disrupt, or attempt to gain unauthorized access to the
App, our servers, or other users’ accounts.
– Use MyPocono to violate any law in your jurisdiction.
We may remove any content or suspend or terminate any account that violates
these Terms, at our sole discretion.
 
6. Moderation and reporting
MyPocono is moderated by our team and by community reports. Content flagged
as violating these Terms may be removed and the associated account
warned, suspended, or terminated. You can report content or a user from
within the App at any time.
 
7. Business listings and claims
Business owners may claim a listing to manage their content. Claims are
verified by our moderation team. Filing a false claim, or misrepresenting
your relationship to a business, may result in permanent removal of your
account and the loss of any active subscription.
 
8. Privacy
Your use of MyPocono is also governed by our Privacy Policy, available in
the App (Profile → Help & Legal → Privacy Policy) and at https://pbnews1.com/privacy-policy. The Privacy Policy explains what data we
collect, how we use it, and the controls you have.
 
9. Intellectual property
MyPocono, including its design, code, and editorial content, is owned by
Pocono Business News and its licensors and is protected by copyright,
trademark, and other laws. You may not use our brands or content outside of
MyPocono without written permission.
 
10. Termination
You may stop using MyPocono at any time. You can delete your account from
Profile → Account → Delete account; your data will be removed within 30 days
as described in the Privacy Policy. Deleting your account does not cancel an
active subscription; you must cancel through the App Store or Google Play
account settings.
We may suspend or terminate your access to MyPocono at any time for any
violation of these Terms, with or without notice. Sections that by their
nature should survive termination (ownership, disclaimers, limitation of
liability, governing law) will survive.
 
11. Warranty disclaimer
MyPocono is provided “as is” and “as available” without warranties of any kind
kind, whether express or implied, including warranties of merchantability,
fitness for a particular purpose, non-infringement, or quiet enjoyment. We
do not warrant that the App will be uninterrupted or error-free, that
defects will be corrected, or that the App is free of viruses or other
harmful components.
 
12. Limitation of liability
To the maximum extent permitted by law, Pocono Business News and its
officers, directors, employees, and agents will not be liable for any
indirect, incidental, special, consequential, or punitive damages arising
out of or in connection with your use of MyPocono. Our total liability to
You for any claim arising out of these Terms or the App will not exceed the
greater of (a) the amount you paid us in the 12 months before the claim, or
(b) fifty US dollars ($50).
 
13. Indemnification
You agree to indemnify and hold harmless Pocono Business News from any
claim, demand, loss, or damages, including reasonable attorney fees,
arising out of or related to your User Content, your use of MyPocono, or
Your violation of these Terms.
 
14. Apple-specific terms
These terms apply if you download MyPocono from the Apple App Store.
Acknowledgement: These Terms are between you and Pocono Business News
only, not with Apple Inc. (“Apple”). Apple is not responsible for
MyPocono or its content.
Scope of license: The license granted to you in Section 1 is limited
to a non-transferable license to use MyPocono on any Apple-branded product
that you own or control and as permitted by the Usage Rules set forth in
the Apple Media Services Terms and Conditions.
Maintenance and support: Pocono Business News is solely responsible
for providing any maintenance and support with respect to MyPocono. Apple
has no obligation whatsoever to furnish any maintenance and support
services.
Warranty: Pocono Business News is solely responsible for any product
warranties, whether express or implied by law, to the extent not
effectively disclaimed. In the event of any failure of MyPocono to
conform to any applicable warranty, you may notify Apple, and Apple will
refund the purchase price for MyPocono to you, to the maximum extent
permitted by applicable law, Apple will have no other warranty obligation
whatsoever with respect to MyPocono.
Product claims: Pocono Business News, not Apple, is responsible for
addressing any claims by you or a third party relating to MyPocono or
your possession or use of MyPocono, including product liability claims,
claims that MyPocono fails to conform to any applicable legal or
regulatory requirement, and claims arising under consumer protection or
similar legislation.
Intellectual property rights: In the event of any third-party claim
that MyPocono or your possession and use of MyPocono infringes that third
party’s intellectual property rights, Pocono Business News, not Apple,
will be solely responsible for the investigation, defense, settlement,
and discharge of any such intellectual property infringement claim.
Legal compliance: You represent and warrant that (i) you are not
located in a country that is subject to a US Government embargo, or that
has been designated by the US Government as a “terrorist supporter”
country, and (ii) you are not listed on any US Government list of
prohibited or restricted parties.
Third-party beneficiary: You and Pocono Business News acknowledge and
agree that Apple and Apple’s subsidiaries are third-party beneficiaries
of these Terms, and that, upon your acceptance of these Terms, Apple will
have the right (and will be deemed to have accepted the right) to enforce
These Terms are against you as a third-party beneficiary thereof.
 
15. Google Play-specific terms
If you download MyPocono from Google Play, your use is also governed by the
Google Play Terms of Service. Pocono Business News, not Google, is solely
responsible for MyPocono and its content, maintenance, and support.
 
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes,
we will notify you inside the App at least seven days before they take
effect. Continued use of MyPocono after the effective date of a revised
version constitutes acceptance of the revised Terms. The current version is always available in the App and on our terms and conditions page.
17. Governing law
These Terms are governed by the laws of the Commonwealth of Pennsylvania,
United States, without regard to conflict of law rules. Any disputeAny 
arising from these Terms or your use of MyPocono will be resolved
exclusively in the state or federal courts located in Monroe County,
Pennsylvania, and you consent to the jurisdiction of those courts.
